Official contest rules

The Mother's Day Contest (the "Contest") is sponsored by Groupe Valérie Simon (the "Sponsor") and is in no way sponsored, endorsed, administered or associated with Meta or its divisions.All persons participating or attempting to participate in the Contest understand that their participation is subject to these Contest Rules, and each participant agrees to be bound by these Contest Rules. 

Contest period

The Contest begins on May 1, 2024 at 7:00 a.m. (Eastern time) and ends on May 12, 2024 at 11:59 p.m. (Eastern time) (the "Contest Period"). 

Conditions of entry;

No purchase is necessary to enter this Contest. Only one entry per person will be accepted. 

To participate in the Contest, an eligible person must comply with the following conditions during the Contest Period and comply with all Contest Rules (the "Participant(s)"). 

To enter the Contest and become a Participant, a person must: 

1. follow @valeriesimon.groupe on Instagram; 
2. Like and share the contest post on Groupe Valérie Simon's social media account; 
3. identify a mom in the comments section of the Contest publication. 

Limit of one (1) entry per Instagram/Facebook account. Entries must be made using the Participant's personal Instagram or Facebook account. Entries made by any other person, company, organization or entity will be declared invalid. It is forbidden to use any device to automate entry. Any attempt to manipulate the Contest will result in the Participant's disqualification. 

Eligibility

This Contest is open to residents of Canada who have reached the age of majority in their province or territory of residence.

The following are not eligible for the competition: 

• - employees, representatives, mandataries and agents of the Sponsor; 
• - a member of the competition jury (if applicable); 
• - all advertising and promotional agencies involved in the Contest, their affiliated and related companies, and all of their employees, representatives, mandataries and agents; 
• - all persons with whom any of the above-mentioned persons is domiciled and all members of the immediate family (parents, siblings and spouse, children, regardless of where they live) and household of any of the above-mentioned persons. 

Winner selection and draw procedures

The Contest draw date is November 14, 2023, at approximately 12 p.m. EST, in Sherbrooke, Quebec. 

On the Draw Date, one (1) entrant will be selected in a computer-generated random draw from among all eligible Entrants at the end of the Contest Period (the "Eligible Winners"). Odds of winning Prizes depend on the number of Eligible Entries. As the number of entries increases, the odds of winning decrease. 

The Eligible Winner will receive a direct Instagram message from the Sponsor within three (3) business days of the draw date. 

In order to be declared a winner and claim the Prize, (the "Prize Winner"), the eligible Winner must: 

1. Respond to Sponsor's Instagram direct message and provide a valid email address within three (3) business days of Sponsor's Instagram direct message. Upon receipt of a valid email address, Sponsor will send a Declaration and Release Form to the email address provided within three (3) business days to the email address provided. 
2. Complete and sign the declaration and waiver form provided by the Sponsor and return it by reply e-mail to the Sponsor, within ten (10) business days of receipt of the e-mail from the Sponsor; 
3. Correctly answer, without assistance of any kind, mechanical or otherwise, a mathematical skill-testing question contained in the Declaration and Release Form.

The Sponsor or designated representative will make at least one (1) attempt to contact each randomly selected entrant by Instagram message. If, at the end of the three (3) business days following the Draw Date, the selected entrants cannot be reached, or if the notification sent to them is returned as undeliverable, the entrant in question will, at the sole discretion of the Contest Organizers, be disqualified (and will lose all rights to the prize in question). In such a case, the Contest Organizers reserve the right, at their sole discretion and time permitting, to randomly select another eligible entrant from among the remaining eligible Entries (in which case, the provisions set out in this section will apply to the new entrant selected); 

Prior to naming a winner, the Sponsor reserves the right to verify and confirm, in its sole discretion, the eligibility of the Eligible Winner, including completion of all required fields of the Declaration and Release Form and compliance by Eligible Winners with all provisions of these Contest Rules. Prize Winners will only be announced once the Sponsor has confirmed to its satisfaction that the Eligible Winners have complied with these Contest Rules. Once the Sponsor has confirmed to its satisfaction that the Eligible Winners have complied with these Contest Rules, the Sponsor will announce the Prize Winners on the @valeriesimon.groupe Instagram account.

Description of prices and retail value of each

A total of 1 prize will be awarded (the "Prizes"): 

• A gift bag of Saint James and Beblue products valued at $500 CAD.

The approximate total value of the Contest Prizes is $500 CAD.

Each prize must be accepted as awarded and may not be transferred, assigned or exchanged for cash (unless explicitly authorized by the Contest Organizers, at their sole discretion). No prize substitution will be possible, except at the discretion of the Contest Organizers. The Contest Organizers reserve the right, at their sole discretion, to substitute the prize, or any portion thereof, with another prize of equivalent or greater value, including, at the sole discretion of the Contest Organizers, cash. The prize will be awarded only to the person whose full name and valid, verifiable e-mail address are entered in association with the Entry in question. 

Prize claims

After announcing the Prize Winners, the Sponsor will ship the Prizes in accordance with its shipping policy available in the FAQ (https://valerie-simon.com/pages/faq) and its return policy, which is also available on the website (https://valerie-simon.com/policies/refund-policy), at the address provided by the Prize Winner in the Declaration and Release Form. The Winner may also pick up his/her prize in one of our physical boutiques.

Shipping charges may apply to claim Prizes, which Prize Winners will be required to pay. All purchases made by the Prize Winner with the Prize amount are subject to Sponsor's policies, including the shipping and return policy set forth above.

Limitation of liability

Without limiting the scope of the waiver, and for greater certainty, the Sponsor will not be responsible for: a) any printing or typographical errors in any material related to the Contest; b) any incorrect or inaccurate information, whether caused by site visitors, by equipment or programming used in or associated with the Contest, or by any human or technical error which may occur in the Contest entry process; c) any error, omission, interruption or any deletion, defect, delay in operation of the Contest website, Contest page, or transmission in connection with the Contest; d) any communications line failure, theft, destruction or unauthorized access to, or alteration of, entries; e) any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of electronic mail on account of technical problems or traffic congestion on the Internet or at any website; or f) any injury or damage to entrants or entrants' computers or damage to third party computers related to or resulting from participation in this Contest. 

If the Contest is not capable of running as planned for any reason, including due to computer virus, computer error, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of the Sponsor, which corrupt or affect the administration, security or proper conduct of this Contest, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Contest, subject to the approval of the Régie des alcools, des courses et des jeux, where required. 

By entering or attempting to enter this Contest, all persons release the Sponsor, their organizers, advertising and promotional agencies, employees, agents and/or representatives from any and all damages that may be suffered as a result of their participation or attempted participation in the Contest. 

General terms and conditions

For Quebec residents only: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement. 

By registering, the Participant declares that he/she has complied with the Contest Rules. Information provided by entrants must be complete and accurate. The Contest Sponsor is not responsible for communication problems, late, incomplete or erroneous prize claims. Incomplete, garbled, late or duplicate entries will be void, resulting in ineligibility to claim a prize. The Sponsor reserves the right to disqualify any individual who violates the Contest Rules, disrupts the entry process or acts in an unsportsmanlike manner. Any attempt to undermine the legitimate operation of the Contest may result in civil and criminal penalties. Prizes may only be substituted at Sponsor's discretion. Entrants agree that Sponsor's decisions and entries are final. Entrants release Sponsor from any and all liability in the event of any litigation related to the Contest or the Prizes. The Contest is not affiliated with Instagram, and entrants release Instagram from all liability. The participant is the person who owns the Instagram account, and this person is responsible for answering the questions and completing the declaration form. The contest is governed by applicable federal, provincial or municipal laws and is prohibited where prohibited by law.

Privacy policy

By entering the Contest, all Participants are asked to consent to the Sponsor's privacy policy (https://valerie-simon.com/policies/privacy-policy) to obtain consent to the collection, use, retention and disclosure of their personal information by the Sponsor and its representatives or agents for the purposes set out in the Privacy Policy, including: in connection with the Contest, the organization of the Contest and the awarding of prizes. The foregoing is not intended to limit any other consent to the collection or use of personal information that may have been or may be provided in the future by an entrant to the Sponsor or any of the other Released Parties, as applicable. Personal information collected in connection with this contest may be stored on one or more servers located outside of Canada.
